Usage & Rental Obligations
• By law, the owner is permitted to use the apartment for a maximum of 60 days per year.
• For the rest of the year, the owner must cede management and rental operations of the apartment to a designated operating company (“Explotadora Única”).
• Before signing the property deeds, the owner will enter into a contract with this operating company, outlining rights and obligations for both parties.
• The operating company handles all aspects of rental management, including marketing, reservations, cleaning, laundry and guest services, charging the owner a commission on rental income.

Tax & Purchase Structure
Purchases at Unique Vera Beach can be made either:
1. With ITP (Impuesto de Transmisiones Patrimoniales)
• Buyers paying under ITP must pay 7% of the purchase price as tax.
2. Under the “Sujeto Pasivo de IVA” regime
• Buyers in this category are exempt from paying IVA or ITP.
• Instead, they pay 1.2% of the purchase price as Actos Jurídicos Documentados (AJD).
• This purchase is structured as an “operation with VAT reverse charge” (Article 84.1.2 of Ley 37/1992), and the seller issues an invoice in the buyer’s name without VAT under this regime.

Ongoing Tax Reporting
• Regardless of whether the apartment is bought under ITP or the VAT reverse charge regime, because the apartment is a licensed tourist property whose management is contracted to a gestora:
◦ The owner must invoice the operating company for the rental income, with 21% VAT and 19% IRPF withholding tax applied.
◦ The owner is required to file quarterly VAT returns (Modelo 303) and the annual VAT summary (Modelo 390).
◦ The rental income must also be included on the owner’s annual Spanish tax return (“Declaración de la Renta”).
